Using BiteWise

BiteWise is a food recommendation app that uses AI to suggest menu items based on your personal taste. You may use the app for personal, non-commercial purposes.

To use BiteWise you must be at least 13 years old. By using the app you confirm that you meet this requirement.

Your account

You are responsible for keeping your account credentials secure. Do not share your password with anyone. If you suspect your account has been compromised, contact us immediately at contact@usebitewise.com.

You can delete your account at any time from the app's Settings. Deleting your account permanently removes all your data.

We reserve the right to suspend or terminate your account at any time if we believe you have violated these terms, abused the service, or engaged in any activity that could harm BiteWise or other users. Where possible, we will notify you before taking action.

Acceptable use

You agree not to:

• Use the app for any unlawful purpose.
• Attempt to reverse-engineer, hack, or interfere with the app or its servers.
• Upload content that is offensive, harmful, or violates anyone's rights.
• Use the app in any way that could damage or overburden our infrastructure.
• Resell or commercially exploit any part of the app without our written permission.

AI recommendations

BiteWise uses AI to generate food recommendations by reading menu images and matching items to your personal taste profile. These are suggestions only — they are not guarantees of quality, accuracy, or availability.

At build-your-own style restaurants (such as Chipotle, Sweetgreen, or similar), BiteWise may construct a complete suggested order from individual menu components. These AI-generated orders are suggestions only; actual menu items, components, and availability are determined entirely by the restaurant.

The AI reads menu text from photos and may occasionally misread items, prices, or descriptions due to image quality, lighting, or unusual formatting. Always verify your order directly with the restaurant.

Allergens and dietary restrictions: BiteWise is not an allergen-detection or dietary safety tool. The AI does not reliably identify allergens, cross-contamination risks, or ingredients that conflict with specific dietary needs (including but not limited to gluten intolerance, nut allergies, or vegan/vegetarian requirements). You are solely responsible for verifying that any food you order is safe for you to consume. Do not rely on BiteWise recommendations as a substitute for your own due diligence regarding food safety.

We are not responsible for your satisfaction with any food ordered based on our recommendations, or for any adverse health outcomes resulting from food ordered using the app.

Intellectual property

The BiteWise app, name, logo, and all content within it are owned by us and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the app without our written permission.

Content you submit to the app — including menu photos, food ratings, notes, and mood input — remains yours. By submitting it, you grant us a non-exclusive, royalty-free licence to store, process, and use that content to provide and improve the BiteWise service, including using it to generate and personalise your recommendations. We may also use this content for future commercial purposes consistent with our Privacy Policy, and will notify you of any material change in how your content is used.

Service availability and rate limits

BiteWise depends on third-party infrastructure and AI services (including Supabase, Anthropic, and TheMealDB). We do not guarantee uninterrupted availability. If any of these services experience outages or changes, features of BiteWise may be temporarily unavailable.

To prevent abuse and ensure fair access for all users, BiteWise enforces rate limits on certain features (such as menu scanning and requesting additional recommendations). If you exceed these limits, requests will be temporarily paused. Rate limits reset automatically over time.

Disclaimer of warranties

BiteWise is provided "as is" without warranties of any kind. We do not guarantee the app will be available at all times, error-free, or that recommendations will meet your expectations. We disclaim all warranties, express or implied, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, BiteWise and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (which, since the app is free, means zero).

Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you through the app or by email. Continuing to use BiteWise after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States.

Apple App Store — additional terms

If you downloaded BiteWise from the Apple App Store, the following terms also apply:

• Parties: These terms are an agreement between you and BiteWise only, not with Apple Inc. Apple is not a party to these terms and has no responsibility for the app or its content.
• Scope of licence: The licence granted to you is limited to a non-transferable licence to use the app on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Maintenance and support: Apple has no obligation to provide any maintenance or support for BiteWise. Any support questions should be directed to us at contact@usebitewise.com.
• Warranty: Apple has no warranty obligations with respect to BiteWise. To the extent permitted by law, any warranty claims should be directed to us, not Apple.
• Product claims: We, not Apple, are responsible for addressing any claims relating to BiteWise, including product liability claims, consumer protection claims, and claims under applicable laws.
• Intellectual property: In the event of any third-party claim that BiteWise or your use of it infringes a third party's intellectual property rights, we, not Apple, will be responsible for the investigation, defence, settlement, and discharge of any such claim.
• Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
• US government end users: If you are a US government entity, the app and related documentation are "commercial items" as defined in 48 C.F.R. §2.101.
